it may be the last stepping stone before acheiving Constitutional protection under the fifth amendment for the LGBT community. And looks like that will happen. I am confident that DOMA will pass with 6/3 & Prop 8 with 5/4
Update: On the second thought, though not directly applicable, applying the commerce class after DOMA being struck down, all states would have to indirectly accept same-sex marriages. Not that I am thrilled by the notion of the federal government interfere with states' rights, but it is done all sorts of non-sensical cases, why not for this?
- strikes down DOMA on the states' rights
- strikes down Prop 8 on procedural grounds
